Responsabilidad internacional de Colombia por la acción u omisión de agentes militares y de policía: análisis de sentencias de la corte IDH

Abstract

Dentro del sistema de protección de los derechos humanos, tanto a nivel universal como regional, se han creado muchas normas legales exclusivamente para garantizar y defender efectivamente los derechos de las personas en sus vidas, dignidad, integridad personal, etc.; sin embargo, es preocupante saber que a pesar de tener un sistema legal que busca proteger estos derechos, los estados continúan llevando a cabo actos que los amenazan y violan, comprometiendo su responsabilidad frente a la comunidad internacional, que enfrenta estas acciones en el ejercicio de la justicia y defensa de los derechos reconocidos en la carta universal de los derechos humanos. Siendo la fuente y la razón de ser de estas normas, el ser humano requiere un reconocimiento integral ante los estados para que restrinja las acciones que socaven sus derechos y pongan en riesgo sus intereses. Así, en el sistema interamericano de derechos humanos, estados como Colombia han sido declarados responsables de la violación de la carta de derechos humanos, en el ejercicio de la actividad arbitraria de sus agentes militares y policiales, responsables de garantizar la seguridad y restablecer el orden público en el interior del país. Within the system of protection of human rights, both at a universal and regional level, many legal norms have been created exclusively to ensure and effectively defend the rights of people in their lives, dignity, personal integrity, etc.; however, it is worrisome to know that despite having a legal system that seeks to protect these rights, states continue to carry out acts that threaten and violate them, compromising their responsibility towards the international community, which faces these actions in the exercise of justice and defense of the rights recognized in the universal charter of human rights. Being the source and raison d'être of these norms, the human being requires a full recognition before the states so that they restrain the actions that undermine their rights and put their interests at risk. Thus, in the inter-American human rights system, states such as Colombia have been declared responsible for violating the human rights charter, in the exercise of the arbitrary activity of its military and police agents, responsible for ensuring security and reestablishing public order within the national territory.
