dc.description.abstractCada día cobra mayor relevancia en Colombia optar por el sistema de vivienda organizada bajo la figura denominada propiedad horizontal o copropiedad. Este sistema de vivienda reúne intereses comunes y también diferentes de las personas y familias que llegan a conformar dicha comunidad, ahora, la anterior variable y el crecimiento exponencial de la propiedad horizontal en el país hace que su administración y la idoneidad para ejercerla sean aspectos de vital importancia para garantizar la armonía y satisfacción de los intereses que regula. Llama la atención que, si bien los órganos de administración de una copropiedad tienen una gran responsabilidad en su ejercicio frente a los altos y complejos intereses de la comunidad que administran, la idoneidad interpretada con base en capacitación, experiencia y otros tópicos que buscan validar, no se están exigiendo en Colombia porque la regulación gubernamental no existe. Lo anterior hace que el ejercicio de la administración de la propiedad horizontal se esté realizando sin un control en cuanto al importante aspecto de la idoneidad lo cual repercute en los problemas administrativos, de convivencia y que dificultan y lesionan el desarrollo del objeto y los principios de la propiedad horizontal, fijados por la misma ley. Se pretende con este trabajo aportar un análisis crítico sobre el tema planteado con base en lo que se ha venido analizando y presentando en fuentes confiables y autorizadas que han estado tratando el tema.spa
dc.description.abstractenglishEvery day it becomes more relevant in Colombia to opt for the housing system organized under the figure called horizontal property or co-ownership. This housing system brings together common and also different interests of the people and families that come to make up said community, now, the previous variable and the exponential growth of horizontal property in the country make its administration and the suitability to exercise it are aspects of vital importance to guarantee the harmony and satisfaction of the interests that it regulates. It is noteworthy that, although the administrative bodies of a co-ownership have a great responsibility in their exercise in the face of the high and complex interests of the community that they administer, the suitability interpreted based on training, experience and other topics that they seek to validate, They are not required in Colombia because government regulation does not exist. The foregoing means that the exercise of the administration of horizontal property is being carried out without control regarding the important aspect of suitability, which has repercussions on administrative problems, coexistence and that hinder and harm the development of the object and the principles of horizontal property, fixed by the same law. It is intended with this work to provide a critical analysis on the subject raised based on what has been analyzed and presented in reliable and authorized sources that have been dealing with the subject.spa
