Los Límites De La Libertad Expresión En El Contexto De Las Nuevas Tecnologías Y Las Redes Sociales

Abstract

Este documento busca indagar por la garantía de los derechos en la crisis de la epistemología de la Ciencia Jurídica, representada en la reformulación de la neutralidad política y objetividad de los saberes técnicos, algo que parece traer al juez la capacidad de examinar crítica y racionalmente las cuestiones éticas o filosóficas que se presenten en la sociedad. Aunque coloquialmente se cae en el discurso de tener una Constitución garantista, existe todo un entramado institucional representado en las Relatorías Especiales de la ONU, y la capacidad vinculante del Tribunal Europeo de Derechos Humanos TEDH, que fija el curso de la Libertad de Expresión en las regiones vinculadas. Por medio del método comparativo, se buscó hallar variables específicas que permitieran identificar líneas de trabajo común entre los dos sistemas jurídicos seleccionados. Se practicó una rejilla de interpretación representada en una matriz de análisis, para identificar algunos aspectos centrales de los relatos de los sistemas jurídicos. This document seeks to investigate the guarantee of rights in the crisis of the epistemology of Legal Science, represented in the reformulation of political neutrality and objectivity of technical knowledge, something that seems to bring the judge the ability to critically and rationally examine the ethical or philosophical issues that arise in society. Although colloquially falls into the discourse of having a guarantee constitution, there is a whole institutional framework represented in the Special Rapporteurs of the UN, and the binding capacity of the European Court of Human Rights ECHR, which sets the course of Freedom of Expression in the linked regions. By means of the comparative method, it was sought to find specific variables that would allow to identify lines of common work between the two selected legal systems. An interpretation grid represented in an analysis matrix was used to identify some central aspects of the legal systems' accounts.
