Alcance del error judicial para la determinación de la responsabilidad patrimonial del estado en Colombia

Abstract

El presente trabajo de investigación surge a partir de las diversas problemáticas planteadas entorno al alcance y el contenido del error judicial determinante para la generación de la responsabilidad estatal por la administración de justicia. Son muchas las interpretaciones que se han hecho por parte del Consejo de Estado y la Corte Constitucional principalmente sobre los elementos que se deben estructurar para el surgimiento de este tipo responsabilidad . Se tiene por finalidad la realización de un estudio exhaustivo que permita dilucidar el error judicial a partir de las distintas perspectivas e interpretaciones y de esta manera determinar cuál de ellas es la más adecuada para ser aplicada en Colombia y que garantice efectivamente el debido proceso y el principio de legalidad en la administración de justicia. Sin embargo, para que el denominado error jurisdiccional pueda generar responsabilidad patrimonial al estado debe dotarse de unos elementos taxativamente descritos en la ley Colombiana como requisitos sine qua non para su surgimiento. Se hace necesario enfatizar que este tipo de responsabilidad derivada del error judicial se configura como una excepción a la regla que procede cuando se constituye una vía de hecho definida esta como This research work arises from the various issues raised around the scope and content of the judicial error that determines the generation of state responsibility for the administration of justice.
