As is evident, in labor law several principles are recognized such as favorability, indubio pro operario, stability and inalienability of the acquired rights, among others. In this regard, it was considered relevant to conduct a study of the principle of the most beneficial condition for old-age and survivor pensions recognition, from the High Court perspective.  In order to determine if it operates a time limit of the mentioned principle, where the minimum rights of affiliates are represented to the General pension and social security system and where the budgetary stability of the system is guaranteed.
Como es palmario, en el derecho laboral se reconocen varios principios como la favorabilidad, indubio pro operario, estabilidad e irrenunciabilidad de derechos adquiridos entre otros. En ese orden de ideas, se consideró relevante hacer un estudio del principio de la condición más beneficiosa para el reconocimiento de pensiones de vejez y sobreviviente bajo la óptica e interpretación de las Altas Cortes, para luego determinar si opera un límite temporal del mencionado principio donde se represeten los derechos mínimos de los afiliados al sistema general de seguridad social en pensiones y se garantice la estabilidad presupuestal del mismo sistema pensionales.
