Abstract

La Constitución Política de 1991, estableció el procedimiento, los mecanismos y órganos facultados para su reforma. Con la objeción del proyecto del acto legislativo y la expedición del decreto 1351 por el Ejecutivo, se transgredió la Constitución Política de hecho, en cuanto se establecieron dos requisitos adicionales al trámite legislativo. No solo el ejecutivo desconoció la carta política, también el legislativo, al reunirse en sesiones extraordinarias no permitidas en el trámite legislativo, de acuerdo a lo establecido en el inciso segundo del artículo 375 ibídem; asimismo lo hizo el poder judicial, en cabeza a la Corte Constitucional y el Consejo de Estado, que al estudiar las demandas presentadas en contra del proyecto y del decreto en mención, decidió, aquella, inhibirse de conocer de las demandas de inconstitucionalidad porque el primero fue archivado por el congreso, sin incorporarse a la vida jurídica, y la segunda por carecer de competencia, esta, decretó nulidad del decreto, pero no se pronunció del proyecto de acto legislativo y menos de lo establecido en la artículo 149 constitucional.
