dc.description.abstractLas rebajas de pena o descuentos punitivos por allanamiento a cargos resultan ser una de las figuras elementales del sistema penal acusatorio implementado por la Ley 906 de 2004, la cual entró en vigencia a partir del 1 de enero de 2005 de manera paulatina y escalonada para cada distrito judicial del país. Sin embargo, la forma de aplicar los descuentos punitivos en el sistema penal acusatorio colombiano por allanamiento a cargos, se encuentra sujeta al reintegro de dineros que realice el procesado; todo ello en virtud del enfrentamiento de dos sentencias de la Corte Suprema de Justicia que contemplan parámetros diferentes en torno a este aspecto.spa
dc.description.abstractenglishPenalty reductions or punitive discounts for accepting criminal charges are one of the elementary figures of the accusatory criminal system implemented by Law 906 of 2004, which entered into force as of January 1, 2005 in a gradual and staggered manner for each judicial district of the country. However, the way of applying the punitive discounts in the Colombian accusatory criminal system, for accepting criminal charges, is subject to the reimbursement of money made by the defendant. All this by virtue of the confrontation of two Supreme Court of Justice’s judgments that contemplate different parameters regarding this aspect.spa
