La creación de juzgados y tribunales constitucionales como una solución para descongestionar de las acciones de tutela a los despachos judiciales en el distrito judicial de Cúcuta

Abstract

La acción de tutela en Colombia se ha convertido en una de las principales causas de la congestión de los despachos judiciales, por lo que se propone crear juzgados y tribunales constitucionales. La investigación presenta la estructura para la creación de los juzgados constitucionales como una solución para descongestionar de las acciones de tutela a los despachos judiciales en el distrito judicial de Cúcuta, para lo que se determinaron las reformas normativas a la administración de justicia que deben efectuarse para llevar a cabo la implementación de juzgados y tribunales constitucionales que permitan descongestionar el sistema juridicial de la carga laboral que significa la acción de tutela, se definió el presupuesto necesario para la creación de juzgados y tribunales constitucionales en el distrito judicial de Cúcuta; y, se establecieron las competencias y las acciones de las cuales podrían conocer los juzgados y tribunales constitucionales. The guardianship action in Colombia, has become one of the main causes of congestion of the judicial offices, so it is proposed to create courts and constitutional courts. The investigation presents the structure for the creation of the constitutional courts as a solution to decongest the guardianship actions to the judicial offices in the judicial district of Cúcuta, for which the normative reforms to the administration of justice were determined that must be carried out for carry out the implementation of constitutional courts and tribunals that will allow to decongest the juridicial system of the work load that the tutela action means, the necessary budget was defined for the creation of constitutional courts and tribunals in the judicial district of Cúcuta; and, the competences and the actions of which the constitutional courts and courts could be informed were established.
