Eficacia de la protección del estado Colombiano respecto de los derechos de los migrantes Venezolanos

Abstract

La crisis humanitaria de Venezuela, aun cuando en un primer momento se creyera que solo trae implicaciones para su Estado y sus habitantes, no es así, pues la violación masiva de Derechos Humanos ha generado el éxodo de sus habitantes a diferentes países de Latinoamérica, entre esos Colombia, país que por su frontera, tiene el deber de garantizar y proteger las garantías fundamentales de los migrantes residentes y los que se encuentran de paso por su territorio. Así las cosas, surge el planteamiento ¿Es eficaz la protección del Estado colombiano respecto de los derechos humanos de los migrantes venezolanos? Puesto que, los migrantes venezolanos por su dignidad como seres humanos, tiene derechos y deberes iguales a los de cualquier ciudadano colombiano, así las cosas, es necesario determinar si la normatividad, las políticas y las medidas tomadas por el Estado colombiano, para hacer frente a esta situación son suficientes o por el contrario requieren de una intervención. Por lo anterior, se estableció como objetivo general: analizar la eficacia de la protección del Estado colombiano respecto de los derechos humanos de los migrantes venezolanos. La presente investigación tiene un enfoque cualitativo, el tipo de investigación es el Interpretativo, el cual se fundamenta en un paradigma humanista, enmarcada en tres etapas, donde se explicará la información que ha sido recogida y de esta manera dar respuesta a la pregunta que dio origen al presente artículo. Thus, the approach arises: Is the protection of the Colombian State effective against the human rights of Venezuelan migrants? Since, Venezuelan migrants, due to their dignity as human beings, have equal rights and duties to those of any Colombian citizen, as well as things, it is necessary to determine whether the regulations, policies and measures taken by the Colombian State, to address to this situation they are sufficient or on the contrary they require an intervention. Therefore, it was established as a general objective: to analyze the effectiveness of the protection of the Colombian State regarding the human rights of Venezuelan migrants. The present research proposal has a qualitative approach, the type of research is the Interpretive, which is based on a humanist paradigm, framed in three stages, where the information that has been collected will be explained and thus answer the question that started our investigation.
