La jurisdicción especial para la paz como componente del sivjrnr

Abstract

El gobierno de Colombia y las Farc-ep, han firmado un acuerdo de paz que contiene un aproximado de 550 disposiciones, de las cuales más de la mitad se encuentra en inactividad. Por el contrario, la que más dinámica ha tenido es el de la denominada Justicia Especial para la Paz, componente del Sistema Integral para la Verdad, Justicia, Reparación y No Repetición -SIVJRNR-, como parte de los Acuerdos de Paz, la cual estudiaremos dentro del trabajo de investigación que aquí se realiza como aporte académico a las ciencias sociales. Huelga afirmar, que no obstante haber aprobación por parte del Congreso de la República de la ley estatutaria de la Justicia Especial para la Paz, aun la Corte Constitucional no ha realizado el estudio de constitucionalidad de la misma. Para fortuna de la seguridad jurídica, mediante sentencia C-674 del 2017, refrendó la Corte Constitucional el Acto legislativo 01 del 2017, génesis del SIVJRNR.

The Colombian government and the FARC-EP have signed a peace agreement that contains an approximate 550 provisions, of which more than half are inactive. On the contrary, the most dynamic has been the so-called Special Justice for Peace, a component of the Integral System for Truth, Justice, Reparation and Non-Repetition -SIVJRNR-, as part of the Peace Accords, which we will study within the research work that is carried out here as an academic contribution to the social sciences. Needless to say, that despite approval by the Congress of the Republic of the statutory law of the Special Justice for Peace, even the Constitutional Court has not conducted the study of its constitutionality. Fortunately for legal security, by ruling C-674 of 2017, the Constitutional Court endorsed Legislative Act 01 of 2017, the genesis of the SIVJRNR.
