La protección de derechos humanos referente al hacinamiento de personas privadas de la libertad en instalaciones policiales

Abstract

Teniendo en cuenta la problemática presentada en materia de hacinamiento de las personas privadas de la libertad en la ciudad de Cúcuta, específicamente en instalaciones policiales, es menester atender a la corresponsabilidad que atañe a las diferentes entidades territoriales e instituciones con incumbencia sobre las personas privadas de la libertad, para analizar si la administración municipal de Cúcuta tiene deberes y obligaciones económicas directas con el instituto nacional penitenciario y carcelario INPEC, a su vez determinar si existen irregularidades administrativas y develar si de alguna de ellas se deriva alguna transgresión de derechos y finalmente, identificar si las personas en condición de detenidos que se encuentran en instalaciones policiales son objeto de violaciones directas sobre sus derechos humanos y sus efectos. Taking into account the problems presented in the area of overcrowding of persons deprived of liberty in the city of Cúcuta, specifically in police facilities, it is necessary to attend to the coresponsibility that concerns the different territorial entities and institutions concerned with persons deprived of the freedom, to analyze if the municipal administration of Cúcuta has direct economic duties and obligations with the national penitentiary and prison institute INPEC, in turn to determine if there are administrative irregularities and to reveal if any of them derives any violation of rights and finally, Identify whether persons in condition of detainees who are in police facilities are subject to direct violations of their human rights and their effects.
