Principios pinheiro aplicados al tratamiento de los segundos ocupantes en los procesos de restitución de tierras en Colombia

Abstract

El objetivo de este paper es analizar el alcance de los principios pinheiro en el tratamiento de los segundos ocupantes en los procesos de restitución de tierras en Colombia. Se trata de un estudio enmarcado en el paradigma histórico-interpretativo, el enfoque cualitativo y el tipo de investigación jurídica. Se aborda en primer lugar las características y naturaleza de los principios pinheiro en el terreno internacional y nacional, luego se analizan las normas internacionales y nacionales relacionadas con los derechos de los segundos ocupantes, y por último, se describen algunos de los aportes de estos principios en el contexto de la restitución de tierras en Colombia. Los resultados muestran que los principios pinheiro pertenecen a la categoría soft law, pero con efectos jurídicos al servir de directriz en los adelantos legislativos y el diseño de políticas públicas. Hace parte del bloque de constitucionalidad y ello implica su observancia dentro de los casos de los segundos ocupantes. The objective of this article is to analyze the scope of the pinheiro principles in the treatment of the second occupants in the land restitution processes in Colombia. It is a study framed in the historical-interpretative paradigm, the qualitative approach and the type of legal research. Dryer first, the characteristics and the nature of the pinheiro principles in the international and national terrain, then the international norms and the names related to the occupying rights are analyzed, and finally, they are fixed in the names of the principles in the context of land restitution in Colombia.Tthe results show that the pinheiro principles belong to the soft law category, but with legal effects in the service of directives in the legislative advances and the design of public policies. it is part of the constitution block and this implies its observation within the occupied cases.
