The ignorance of the guardian about the aims and functions of penalty, originated in the impreci- sions and legal emptinesses on the matter and in an insufficient penitentiary instruction, makes that in jail the penitentiary agents contribute with the crisis of this institution that represents the darkest and useless chapter of the Criminal law, where there gets lost all the effort of the doctrine and the jurisprudence that for centuries has tried to justify penalty.
El desconocimiento por parte del guardián acerca de los fines y funciones de la pena, originado en las imprecisiones y vacíos legales sobre la materia y en una insuficiente instrucción penitenciaria, hace que en la cárcel los agentes penitenciarios contribuyan con la crisis de esta institución que representa el capítulo más oscuro e inútil del Derecho Penal, donde se pierde todo el esfuerzo de la doctrina y la jurisprudencia que durante siglos ha tratado de justificar la pena.
