La postura adoptada por la corte interamericana de derechos humanos frente a la pena de muerte

Abstract

Cada día alguien llega al fin de su camino, los seres humanos son frágiles y finitos, esa es su belleza más preciada. Sin embargo, a pesar de esta realidad inevitable, en ocasiones los seres humanos deciden racionalmente privar arbitrariamente la vida de otra persona. Esto es lo que se conoce como la pena de muerte. Este artículo trata de humanizar esta realidad por medio de los derechos humanos, así que lo que se quiere es mostrar la postura adoptada por la Corte Interamericana de Derechos Humanos [Corte IDH] frente a la pena de muerte. Para poder conseguir esta meta se busca describir los aspectos generales de la pena de muerte y la relación entre ésta y los derechos humanos, utilizando la jurisprudencia de la Corte IDH. Se aplica un enfoque ius filosófico, haciendo uso del método hermenéutico, a partir de fuentes secundarias como la jurisprudencia y la doctrina. However, despite this inevitable reality, humans sometimes rationally decide arbitrarily deprive life of another person. This is what is known as the death penalty. This article attempts to humanize this reality through human rights, so what you want is to show the position taken by the Inter-American Court of Human Rights [Court HR] against the death penalty. In order to achieve this goal it seeks to describe the general aspects of the death penalty and the relationship between it and human rights, using the jurisprudence of the Court. ius philosophical approach is applied, using the hermeneutical method, from secondary sources such as jurisprudence and doctrine.
