| dc.description.abstract | La presente investigación sobre la VULNERACIÓN A LA INDEPENDENCIA JUDICIAL A TRÁVES DE LA TUTELA CONTRA DECISIONES JUDICIALES EN EL PERIÓDO 2008 A 2009, EN EL DISTRITO JUDICIAL DE MANIZALES - ÁREA CIVIL se realizó teniendo en cuenta los siguientes aspectos: El problema central del estudio fue la VULNERACIÓN A LA INDEPENDENCIA JUDICIAL A TRÁVES DE LA TUTELA CONTRA DECISIONES JUDICIALES. - Desconocimiento por parte del Juez de tutela, de los límites propios de la jurisdicción constitucional. - El Juez de tutela hace prevalecer aspectos subjetivos sobre el derecho. - Errónea interpretación por parte del Juez constitucional respecto de los precedentes jurisprudenciales sobre la materia. - Inobservancia de normas jurídicas vigentes y aplicables al caso. - Violación al principio del juez natural. - Violación al debido proceso. - Inseguridad Jurídica. | spa |
