Regulación legal de la evasión y elusión en el sistema general de riesgos laborales en Colombia

Abstract

En el ordenamiento jurídico colombiano las disposiciones que regulan el sistema general de riesgos laborales cuentan con un gran respaldo, máxime que el legislador ha sido oportuno en evidenciar los malos comportamientos que surgen por parte de las personas encargadas a la hora de cumplir con la obligación de realizar la afiliación y los debidos aportes a las administradoras de riesgos laborales. El espíritu de la presente investigación se encuentra principalmente en la evasión y elusión que se le hace al sistema general de riesgos laborales y para abordar el tema se realiza i) una exposición del marco normativo del SGRL, ii) se analizan los entes de control, iii) se analizan los mecanismos o procedimientos sancionatorios y iv) posteriormente se dan las conclusiones. Para lograr el resultado obtenido se utilizó como metodología, la investigación de tipo jurídico, con un enfoque cualitativo, con alcance explicativo, al igual se tuvo como instrumento una matriz de análisis legal. Con base a lo anterior, se obtuvo que la evasión y elusión afecta el buen cumplimiento de los principios rectores del Sistema obstruyendo la viabilidad del mismo y la equidad para garantizar el derecho a una vida digna. In the Colombian legal system, the provisions that regulate the general system of occupational risks have a great support, especially since the legislator has been opportune to highlight the bad behavior that arise on the part of the people in charge when fulfilling the obligation of affiliation and due contributions in the ARL. The spirit of the present investigation is mainly in the evasion and elusion that is made to the general system of labor risks and to address the issue is made; first, an exposition of the normative framework of the SGRL; Second, the control and third entities are analyzed, sanctioning mechanisms or procedures are analyzed, and in order to achieve this, legal research with a qualitative approach was used as a methodology, with explanatory scope, as well as an analytical matrix legal. Based on the above, it was obtained that evasion and avoidance affects the good compliance of the guiding principles of the system obstructing the viability of the same and the equity to guarantee the right to a dignified life.
