dc.description.abstractEl presente coactivo trabajo, es el resultado de un proceso de revisión documental de las normas y los conceptos teóricos que rigen el proceso de cobro coactivo en general en Colombia, desde una óptica teórico práctica, del proceso de cobro coactivo que adelanta la Secretaria de Movilidad para el cobro de las infracciones de tránsito en la ciudad de Bogotá. Describe las pautas específicas que rigen el cobro coactivo y además establece los puntos coincidentes y diferentes que existen entre la teoría general del proceso de cobro coactivo y el procedimiento coactivo adelantado en la Secretaria de Movilidad de Bogotá; concluyendo que la jurisdicción coactiva ejercida por las entidades del Estado en sus procesos de cobro encuentra su fundamento en un lineamiento especifico expedido por el legislador para la recuperación de cartera, por lo que el tratamiento para este tipo de procedimiento es semejante y coincidente para todos aquellos que utilizan la facultad exorbitante y extraordinaria otorgada por el legislador y se rigen por los postulados básicos de los procesos civiles de cobro, o procesos ejecutivos ampliamente conocidos y aceptados por la comunidad en general frente a los tramites de cobro.spa
dc.description.abstractenglishThe present work is the result of a documentary review process of the norms and theoretical concepts that govern the coercive collection process in general in Colombia, from a theoretical and practical perspective, of the coercive collection process carried out by the Ministry of Mobility for the collection of traffic offenses in the city of Bogotá. It describes the specific guidelines that govern coercive collection and also establishes the coinciding and different points that exist between the general theory of the coercive collection process and the coercive procedure carried out in the Bogotá Mobility Department; concluding that the coercive jurisdiction exercised by State entities in their collection processes is based on a specific guideline issued by the legislator for portfolio recovery, so that the treatment for this type of procedure is similar and coincident for all those that use the exorbitant and extraordinary power granted by the legislator and are governed by the basic postulates of civil collection processes, or executive processes widely known and accepted by the community in general in relation to collection procedures.spa
