| dc.description | The only justice that will achieve the ideal preached if in practice offers actually to be fair to the victims of unjustified violence. A justice that is done on an individual basis and seeking to meet specific ethical virtue of justice through law, has to be of service to the victims of unjustified violence. Justice has to overcome the material being abstract and, therefore, the focus of justice must necessarily be the victims of unjustified violence. A justice that emphasizes the victims, must be designed for the right, otherwise than as has traditionally been thought. The modern abstract discourse about justice must be overcome by the construction of a justice founded in memory of the victims. A new discourse is urgent for justice to be fair. In particular, the great catastrophes of war and human extermination policies have to rethink about the need to base a new discourse of justice. This is the discourse of anamnetic justice. | en-US |
| dc.description | que predica si en la práctica ofrece la realidad de ser justa con las víctimas de las injustificadas violencias. Una justicia que se realice en forma individualizada y concreta que pretenda satisfacer la virtud ética de la justicia, por medio del derecho, tiene que estar al servicio de las víctimas de las violencias injustificadas, tiene que superar el carácter abstracto y ser material; por consiguiente, su foco de atención tiene necesariamente que ser las víctimas de las injustificadas violencias. Una justicia que haga énfasis en las víctimas, tiene que ser pensada por el derecho, en forma distinta a como tradicionalmente lo ha sido. El discurso abstracto de la modernidad acerca de la justicia tiene que ser superado mediante la construcción de una justicia fundada en la memoria de las víctimas. Un nuevo discurso es inaplazable para que sea justa. En particular, las grandes catástrofes de las guerras y las políticas de exterminio humano han puesto a replantear acerca de la necesidad de fundamentar un nuevo discurso de la justicia.
