Aplicación del mecanismo del fast track (vía rápida) o procedimiento legislativo especial para la paz por parte del congreso de la república durante los años 2016 y 2017

Abstract

La terminación de la vigencia fast track como mecanismo alternativo del procedimiento legislativo para concretar las reformas enmarcadas por el acuerdo de paz abre la posibilidad de determinar y estudiar la trascendencia de modalidades diferentes a la ordinaria, para modificar la constitución política y las leyes de manera rápida. Por eso, el presente trabajo trazo como objetivo principal analizar el fast track conforme a los resultados obtenidos en materia legislativa. Desde ese enfoque, se plantean tres capítulos que resuelven el objeto de la investigación. Inicialmente, se establece el sustento normativo y jurídico del fast track con el fin de conocer sus potencialidades en el marco del sistema colombiano. Luego, se fija la forma en que operó el procedimiento en mención, para reconocer su efectividad. Para culminar, se identifican las reformas que fueron tramitadas a través de dicho mecanismo. The termination of the fast track validity as an alternative mechanism of the legislative procedure to concretize the reforms framed by the peace agreement opens the possibility of determining and studying the transcendence of modalities different from the ordinary, to modify the political constitution and the laws in a fast manner. Therefore, the main objective of this paper is to analyze the fast track according to the results obtained in legislative matters. From this perspective, three chapters are proposed that resolve the object of the investigation. Initially, the normative and juridical support of fast track is established in order to know its potential within the framework of the Colombian system. Then, the way in which the procedure in question was operated is set to recognize its effectiveness. To finish, the reforms that were processed through this mechanism are identified.
