Abstract

El siguiente artículo presenta los resultados de la investigación realizada sobre las garantías que se encuentran reconocidas por la Corte Constitucional en el Periodo 2016-2019, debido a que en este se consolidan las resoluciones expedidas por el Gobierno Nacional en cuanto al acceso a la educación media de los menores migrantes que habitan en el departamento de Norte de Santander y en todo el territorio colombiano. De igual forma se revisó la normatividad existente a nivel internacional que se encuentran ratificadas por Colombia donde se ampara el derecho a la educación en menores migrantes. El presente artículo corresponde a un estudio cualitativo de investigación de corte descriptivo y jurídico, basado en el análisis de investigación documental de textos, artículos, libros y sentencias. Dando respuesta a los objetivos planteados, en primer lugar, se pretende especificar en el ordenamiento colombiano los principales tratados internacionales que hacen parte del bloque de constitucionalidad tendiente a garantizar el derecho a la educación. Luego, se procede a explicar cuáles han sido los principales pronunciamientos de la Corte Constitucional en relación con el derecho a la educación en Colombia, así como las dificultades encontradas para que estas garantías se brinden para la totalidad de la población migrante. The article presents the results of the investigation carried out on the guarantees that are recognized by the Constitutional Court in the 2016-2019 period, because this consolidates the resolutions issued by the National Government regarding access to secondary education for migrant minors who live in the department of Norte de Santander and throughout the Colombian territory. Likewise, the existing regulations at the international level that are ratified by Colombia where the right to education is protected in migrant minors were reviewed. This article corresponds to a qualitative study of descriptive and legal research, based on the analysis of documentary research of texts, articles, books and sentences. In response to the stated objectives, in the first place, it is intended to specify in the Colombian order the main international treaties that are part of the constitutional block aimed at guaranteeing the right to education. Then, we proceed to explain what have been the main pronouncements of the Constitutional Court in relation to the right to education in Colombia, as well as the difficulties encountered in ensuring that these guarantees are provided for the entire migrant population.
