Abstract

Existe un choque de valores entre la tendencia inquisitiva del proceso disciplinario por no diferenciar entre funcionarios competentes a la hora de adelantar la indagación, la investigación y el juicio, atribuyendo la competencia al mismo funcionario lo cual, se podría ver como un problema ante la necesidad de la imparcialidad de los agentes juzgadores, frente a la investigación que, en comparación con otros sistemas de tipo sancionatorio como el sistema penal acusatorio, hace una clara diferenciación de agentes competentes de conocimiento en las etapas. En este punto deja una duda respeto a la legalidad del código, debido a que si bien todo estatuto debe tener unas garantías desarrolladas para permitir un orden justo hay crítica respeto a la falta de aplicación del principio de imparcialidad en la competencia para investigar y juzgar.
