Garantías en los procesos de selección y elección de los jueces de la corte interamericana de derechos humanos

Abstract

El SIDH tiene un componente jurisdiccional representado a través de la Corte IDH que mediante su jurisprudencia interpreta la normativa contenida en la Convención IDH y cualquier otro tratado y convenio internacional de su competencia. Las decisiones de la Corte IDH es un criterio jurídico importante en materia de DDHH que los Estados Miembros deben respetar con fundamento en el control de convencionalidad. El comportamiento internacional de los Estados Latinoamericanos se caracteriza por respetar las decisiones de la Corte IDH, en gran parte, por la idoneidad, imparcialidad e independencia de los miembros que componen a la Corte IDH. Precisamente, este artículo tiene como propósito determinar las garantías que existen en los procesos de selección y elección de los Jueces de la Corte Interamericana de Derechos Humanos. Lo anterior, permitirá comprender cómo el SIDH garantiza que los miembros de la Corte IDH deciden con imparcialidad e idoneidad. The IAHRS has a jurisdictional component represented by the Inter-American Court which through its jurisprudence interprets the regulations contained in the American Convention and any other international treaty and agreement within its jurisdiction. The decisions of the Inter-American Court is an important legal criterion in the field of human rights that member states must respect based on conventional control. The international behavior of Latin American States are characterized by respecting the decisions make by the Inter-American Court, in large part, by the suitability, impartiality and independence of the members that integrate the Inter-American Court. Precisely, this article aims at determine the legal guarantee that exist in the selection and election process of the Judges of the Inter-American Court of Human Rights. Due to the above, it will allow the reader to understand how the IAHRS warrants that members of the Inter-American Court decide with impartiality and suitability.
