Abstract

El derecho a la salud en Colombia es un derecho fundamental autónomo e irrenunciable, contemplado en el artículo 49 de la Constitución Política a cargo del Estado. Es un derecho indispensable para los seres humanos, para hacer efectiva la base del Estado Social de Derecho, la dignidad humana y la vida en adecuadas condiciones y mínimos. El derecho a la salud es un derecho fundamental por la condición de inherente al ser humano, que se predica en su totalidad en la existencia del hombre en todo tiempo y lugar, es decir, desde el inicio de la vida hasta su finalización, que permite vivir en condiciones dignas, tanto físicas, espirituales como morales, mediante la utilización de medios de prevención, recuperación y protección de la salud. El Estado Social de Derecho debe garantizar este derecho mediante políticas económicas y sociales junto con entidades privadas, la Sociedad y los mismos individuos deben respetar y ayudar al cumplimiento de este derecho. En nuestro país existen diversas circunstancias de vulneración al derecho a la salud de tal manera que ha afectado las condiciones de vida de determinadas poblaciones. The right to health in Colombia is an autonomous and inalienable fundamental right, contemplated in article 49 of the Political Constitution by the State. It is an indispensable right for human beings, to make effective the basis of the Social State of Law, human dignity and life in adequate conditions and minimum. The right to health is a fundamental right for the inherent condition of the human being, which is preached in its entirety in the existence of man at all times and places, that is, from the beginning of life to its completion, which allows Living in dignified conditions, both physical, spiritual and moral, through the use of means of prevention, recovery and protection of health. The Social State of Law must guarantee this right through economic and social policies together with private entities, the Society and the same individuals must respect and help the fulfillment of this right. In our country there are various circumstances of violation of the right to health in a way that has affected the living conditions of certain populations.
