| dc.description.abstract | El presente artículo analiza el poder de reforma de la Constitución en Colombia, y para ello se tienen en cuenta como acercamiento a la realidad las implicaciones jurídicas que conlleva la iniciativa de modificación estructural del Congreso de la República, que fue presentada por la bancada del Centro Democrático. En atención a lo anterior, se utilizó una investigación cualitativa en el marco de la metodología socio jurídica, lo que permitió conocer la estructura del Congreso a la luz del principio de soberanía popular; de igual manera, se realizó un análisis de la jurisprudencia y la doctrina, que concluyó en determinar el contenido, alcance e implicaciones del poder de reforma de la Constitución de 1991, y se examinó la forma en que el proyecto de acto legislativo, que busca modificar la estructura del Congreso, afecta los principios democrático y de supremacía constitucional, así como también se ven transgredidos los límites del poder de reforma de la Constitución, lo que per se implica una sustitución de la misma. | spa |
| dc.description.abstractenglish | This article analyzes the power to reform the Constitution in Colombia and for this purpose, the legal implications of the initiative for the structural modification of the Congress of the Republic, presented by the Centro Democrático bench, are taken into account as an approach to reality. In view of the above, a qualitative research was used within the framework of the socio-legal methodology. The foregoing allowed knowing the structure of the Congress in the light of the principle of popular sovereignty; likewise, an analysis of the jurisprudence and doctrine was made, which concluded in determining the content, scope and implications of the power to amend the Constitution and examined the way in which the draft legislative act that seeks to modify the structure of the Congress affects the democratic principles and constitutional supremacy, as well as how the limits of the power to amend the Constitution are transgressed, which per se implies a substitution of the same. | spa |
