Problemas jurídicos del cobro de foto detección por el municipio de villa del rosario en la autopista internacional de San Antonio

Abstract

Las fotomultas han sido actuaciones administrativas y particulares que en constantes escenarios fueron discutidas por la sociedad en general, es por eso, que su aceptación dentro de la ciudadanía es desfavorable. A pesar de lo anterior, las fotomultas en la actualidad están vigentes, y su operación se ha venido regulando a través de leyes y decretos que buscan precisar la proyección de estos tipos de sanciones de tránsito. Este es el caso del Municipio de Villa del Rosario, entidad territorial que suscribió con un particular el manejo de las fotomultas de una manera a “primera vista” desfavorable para la municipalidad. En razón a lo anterior, el presente trabajo tiene como objetivo establecer los principales problemas que se generan en la procedencia del cobro de fotomultas por el Municipio de Villa del Rosario en la Autopista internacional Simón Bolívar vía San Antonio. En su desarrollo se identifican las motivaciones que impulsaron la instalación del sistema de fotomultas en la Autopista internacional Simón Bolívar vía San Antonio a su paso por el Municipio de Villa del Rosario; se revisa el contrato de concesión de fotomultas celebrado entre el ente municipal empresa DATRANS y un particular; y se examina la legalidad y la viabilidad del sistema de fotomultas como mecanismo para controlar el tráfico terrestre en la autopista internacional de Villa del Rosario. The fotomultas have been administrative and particular actions that in constant scenes were discussed by the society in general, that is why, its acceptance within the citizenship is unfavorable. In spite of the above, the photomult is currently in force, and its operation has been regulated through laws and decrees that seek to specify the projection of these types of traffic sanctions. This is the case of the Municipality of Villa del Rosario, a territorial entity that signed with a private individual the management of the photomulses in a way that was "unfavorable" for the municipality. In view of the above, the present work has as objective to establish the main problems that are generated in the origin of the collection of photomultas by the Municipality of Villa del Rosario on the Simón Bolívar international highway via San Antonio. In its development the motivations that impelled the installation of the system of photo fines in the international highway Simón Bolívar via San Antonio to its passage through the Municipality of Villa del Rosario are identified; the fotomultas concession contract concluded between the municipal entity DATRANS and a private individual is reviewed; and the legality and viability of the photomult system is examined as a mechanism to control land traffic on the Villa del Rosario international highway.
