La migración en Colombia, entre las fortalezas y los desafíos

Abstract

En el presente artículo se presenta los resultados de la investigación realizada con el fin de revisar el ordenamiento jurídico colombiano frente a la protección de los derechos humanos de los migrantes, donde se consideró la bibliografía existente en el tema de migración irregular, la normatividad jurídica y de manera particular la jurisprudencia, así como se utilizan de manera muy importante los tratados internacionales en materia de migración y protección de derechos humanos, resaltando las fortalezas y los desafíos que enfrenta el Estado Colombiano y su ordenamiento jurídico frente al fenómeno de la migración. This article presents the results of the research carried out in order to review the Colombian legal system against the protection of the human rights of migrants, where the existing bibliography on the topic of irregular migration, legal regulations and in particular the jurisprudence, as well as the international treaties on migration and protection of human rights are used very importantly, highlighting the strengths and challenges facing the Colombian State and its legal system against the phenomenon of migration.
