Alcances de la función notarial frente a la escritura pública desde un marco normativo y cultural

Abstract

La figura del notario se ha caracterizado por ser de especial importancia, en el momento de protocolizar o darle solemnidad a los actos que día a día las personas realizan como un negocio. Por ello, acuden al notario para que este en virtud de sus funciones declare fe pública sobre el documento o escritura que desean realizar, previa revisión, consejo y posibles correcciones del notario. Sin embargo, desde el punto de vista cultural la comparecencia del notario ante el documento no se materializa, es decir, en su mayoría el notario no está presente en el acto. Por lo anterior, esta investigación tiene un enfoque normativo y cultural de las funciones de comparecencia del notario en Colombia. The figure of the notary has been characterized by being of special importance, in the moment of registering or giving solemnity to the acts that people carry out every day as a business. Therefore, they go to the notary so that he can declare public faith in the document or writing they wish to make, after revision, advice and possible corrections by the notary. However,from a cultural point of view, the appearance of the notary before the document does not materialize, that is to say, the notary is not present at the event. For the above, this research has a normative and cultural approach to the functions of notary appearance in Colombia.
