Evolución jurídica de la figura de la herencia yacente en Colombia, a la luz del código civil y el código general del proceso en Colombia

Abstract

Esta investigación versa sobre la evolución jurídica de la figura de la herencia yacente en Colombia, a la luz del Código Civil y el Código General del Proceso, para lo que se examina lo consagrado en el Código Civil respecto a la figura de la herencia yacente en Colombia; se determina lo establecido en el Código General del Proceso frente al a figura de la herencia yacente en Colombia; y, se identifican los aspectos en que evolucionó la medida cautelar de la herencia yacente consagrada en el Código Civil colombiano, frente al Código General del Proceso. El trabajo se enmarca en la naturaleza jurídica, su enfoque es el cualitativo, y el diseño es hermenéutico, todo lo anterior fundamentado en el estudio del Código Civil y el Código General del Proceso colombianos. This investigation deals with the legal evolution of the figure of the inheritance lying in Colombia, in the light of the Civil Code and the General Code of the Process, for which it is examined what is enshrined in the Civil Code regarding the figure of the inheritance lying in Colombia; the provisions of the General Code of the Process are determined against the figure of the inheritance lying in Colombia; and, the aspects in which the precautionary measure of the recumbent inheritance enshrined in the Colombian Civil Code, compared to the General Process Code are identified. The work is framed in the legal nature, its approach is qualitative, and the design is hermeneutical, all of the above based on the study of the Colombian Civil Code and the General Code of the Process.
