| dc.description.abstract | La figura del desistimiento tácito busca inducir a las partes a cumplir con el deber de ser diligentes y promover sus actos, por ello en el presente estudio se analiza la necesidad de que su aplicación se realice teniendo en cuenta las circunstancias del asunto en concreto, sin desconocer el principio constitucional de que lo sustancial prevalece sobre lo procesal. Para su desarrollo se empleó el método cualitativo y explicativo, utilizando fuentes secundarias tales como jurisprudencia y doctrina, las cuales permitieron evidenciar que esta sanción procesal contribuye a combatir las negligencias procesales de algunos profesionales del derecho cuando se le impone una carga procesal, y lograr la descongestión de los despachos judiciales. | spa |
| dc.description.abstractenglish | The figure of tacit withdrawal seeks to induce the parties to comply with the duty to be diligent and promote their actions. Therefore, this study analyzes the need for its application to be carried out taking into account the circumstances of the specific matter, without disregarding the constitutional principle that the substantial prevails over the procedural. For its development, the qualitative and explanatory method was used, using secondary sources such as jurisprudence and doctrine, which made it possible to show that this procedural sanction contributes to combat the procedural negligence of some legal professionals when a procedural burden is imposed on them, and to achieve the decongestion of judicial offices. | spa |
