| dc.description.abstract | La promoción de los principios generales de la contratación, busca la continua y eficiente prestación de los servicios e intereses de la sociedad, lo que ha generado a lo largo del tiempo regular y normativizar la Contratación Pública, con ocasión a que en tiempos pasados cuando no se encontraba la lupa encima del presupuesto general de la Nación frente a los gobernantes y administradores de turno, se prestaba la situación para la existencia de irregularidades millonarias. Para lo cual se han creado leyes, normas, guías y entre otros que preservan los fines esenciales del Estado. Siendo así, las entidades estatales deben adoptar medidas preventivas, correctivas y sancionatorias con ocasión a cualquier situación prevista o imprevista ,la necesidad de tener una exhaustiva y rigurosa vigilancia en los Contratos Estatales es el cumplimiento de las obligaciones que se han visto comprometidas bajo el presupuesto del Estado y además de esto en qué condiciones se comprometen, puesto que en el momento en el que el supervisor deba rendir cuentas a la entidad o a un organismo externo de control, pueden haber repercusiones disciplinarias, fiscales o penales. Cabe resaltar que no es posterior a la celebración del contrato la única oportunidad para que el mismo se pueda ver contaminado por la corrupción1 si es del caso, pues desde la etapa pre contractual existen puntos milimétricos en los que se puede abarcar un desfalco fiscal; cabe resaltar que en la etapa pre contractual se realizan pasos indispensables para su celebración, como lo son los estudios previos, el análisis del sector, se estipulan las especificaciones técnicas mínimas exigidas, se describe la necesidad a satisfacer, el objeto del contrato, la modalidad de selección que se tendrá en cuenta2, la perspectiva legal, técnica y económica. Además de esto los precios históricos, el análisis del riesgo entre otros que sirven de soporte para poder estructurar el debido proceso contractual. | spa |

Therefore, when the public budget is compromised under a contract, there must be means of control for its proper functioning and compliance, and to fulfill this duty, the figure of the supervisor and auditor arises, which is created to protect administrative morality and corruption. through a technical, administrative, financial, accounting and legal monitoring of the contractual object, for this among many other reasons, the subject designated to carry out the monitoring must have minimum qualities in the knowledge of the contracted activity, however simple the obligations to be fulfilled may seem . This refers us to article 83 of Law 1474 of 2011, which explains the figures and in which cases the auditor is required for due follow-up, because it is not necessary in all state contracts. The controller is an independent contractor, who has the function of monitoring and monitoring for compliance with the contract when it is required to support the supervisor designated by the entity, carry out administrative and technical activities, which are of specialized knowledge in certain fields of action. . The supervisor is a public official who has the same obligations, which are to monitor and monitor compliance with the contract and is chosen in the first instance when the object of the contract to be supervised does not require technical and specialized knowledge. Likewise, supervisors, as a priority duty, will permanently inform the State Entity of all the scopes reached in a supervised contract, in order to give prior notice to a possible conduct of corruption or punishable conduct since it would constitute a very serious fault towards the public servant, to ignore or not inform in a timely manner. Therefore, if a joint analysis is carried out, the supervisor may be involved in legal, criminal, disciplinary, fiscal, patrimonial and economic consequences.
