Ineficacia del acto jurídico de traslado entre el régimen de prima media con prestación definida y el régimen de ahorro individual con solidaridad por falta al deber de información

Abstract

En este artículo se analizan las consecuencias derivadas de la falta o indebida información al momento de realizar el traslado de régimen prima media con prestación definida al régimen de ahorro individual con solidaridad, de cómo ésta vicia el consentimiento y como consecuencia de ello invalida el acto jurídico del traslado. Dicho análisis está soportado en el estudio de diversas sentencias que la corte suprema de justicia – sala laboral ha proferido sobre el tema, haciendo también un recorrido por la normatividad más relevante respecto del deber de información. This article analyzes the consequences derived from the lack or improper information at the moment of transferring the average premium scheme with a defined benefit to the individual savings scheme with solidarity, how it vitiates the consent and as a consequence of this invalidates the legal act of the transfer. This analysis is supported in the study of various judgments that the supreme court of justice – sala laboral has proffered on the subject, also making a tour of the most relevant regulations regarding the duty of information.
