dc.description.abstractEl presente trabajo busca realizar un análisis jurídico de un asunto sensible para la sociedad, como es el tema del aborto, aspecto relevante en el marco de un Estado Social de Derecho. El problema jurídico consiste en determinar si las decisiones de la Corte Constitucional respecto al aborto, especialmente la sentencia reciente C-055 de 2022, generan una extralimitación de la Corte Constitucional al aplicar la figura de la “sustitución de la constitución” para decidir el asunto desde cuestiones de fondo y no solo de forma; todo ello visto desde la dogmática propia del Derecho Constitucional.spa
dc.description.abstractenglishThis paper seeks to carry out a legal analysis of a sensitive issue for the society, such as the issue of abortion, a relevant aspect in the framework of a State Social Law. The legal problem is whether the decisions of the Constitutional Court regarding abortion, especially the recent judgment C-055 of 2022, generate an overreach of the Constitutional Court by applying the Figure of the "Substitution of the Constitution" to decide the matter from of substance and not only of form; all this seen from the dogmatics of the Law Constitutional.spa
