Procedencia de la acción de tutela como mecanismo excepcional para la reclamación de acreencias laborales

Abstract

El presente artículo se desarrolló con el fin de establecer el grado de protección y procedencia excepcional de la vía acción de tutela cuando se requiere la reclamación de acreencias laborales, planteando tres objetivos específicos, primero, analizar el fundamento constitucional de los derechos económicos, sociales y culturales, desc; segundo, analizar la jurisprudencia de los desc y tercero, examinar la regulación constitucional y jurisprudencial sobre el mínimo vital. La metodología empleada estuvo basada en un método de estudio exploratorio e interpretativo, además, de documental, pues se realizó una recopilación y análisis de diferentes sentencias de la corte constitucional sobre el mínimo vital y la reclamación de acreencias laborales vía acción de tutela. Dando como conclusión, que los derechos económicos, sociales y culturales ha sido ratificados por diferentes sentencias como derechos fundamentales y que en esta medida el mínimo vital se considera al mínimo de cosas materiales que el trabajador necesita para llevar una vida digna, por eso se considera que la acción de tutela es procedente para la reclamación de acreencias laborales, en virtud del mínimo vital tiene conexidad con otros derechos fundamentales, cuando el salario es la única fuente de ingresos y su ausencia pueda llevar al trabajador a sufrir una precaria situación económica.

The present article was developed with the purpose of establishing the degree of protection and exceptional origin of the action of tutela action when the claim of labor credits is required, proposing three specific objectives, first, to analyze the constitutional basis of the economic, social and economic rights. cultural, desc; second, analyze the jurisprudence of the escr and third, examine the constitutional and jurisprudential regulation on the vital minimum. the methodology used was based on a method of exploratory and interpretative study, in addition to documentary, since a compilation and analysis of different sentences of the constitutional court on the vital minimum and the claim of labor claims through tutela action was made. Giving as a conclusion, that economic, social and cultural rights have been ratified by different judgments as fundamental rights and that in this measure the vital minimum is considered to be the minimum of material things that the worker needs to lead a dignified life, that is why it is considered that the action of tutelage is appropriate for the claim of labor claims, by virtue of the vital minimum has connection with other fundamental rights, when the salary is the only source of income and its absence can lead the worker to suffer a precarious economic situation.
