Análisis de la incorporación de las ideas de Jhon Rawls sobre la igualdad y justicia política en la Constitución colombiana de 1991

Abstract

La Constitución Política de 1991 significó un nuevo paradigma en la modernización, en cuanto modificó la concepción tradicional del desarrollo social y la superación de los límites de las condiciones vitales, logrando dimensionar la elección de vida y las libertades políticas, económicas y garantías de Derechos Humanos. Se ha planteado como hipótesis la incorporación de las ideas de Jhon Rawls en la Constitución, tomando como base el principio de igualdad y los enfoques de justicia social incluidos en algunas sentencias consideradas hito en materia de derechos sociales. Las ideas de igualdad de oportunidades, sujeto colectivo, otorgamiento de derechos a comunidades, justicia política, permiten abordar a Jhon Rawls desde sus posturas ideológicas, para luego interpretar el activismo judicial y su significado a la luz de la teoría de la justicia, como nueva interpretación de la Constitución y de la jurisprudencia. The Political Constitution of 1991 signified a new paradigm in modernization, in that it modified the traditional conception of social development and the overcoming of the limits of vital conditions, achieving a dimension in the choice of life and the political, economic freedoms and guarantees of Human Rights. The incorporation of the ideas of John Rawls into the Constitution has been hypothesized, based on the principle of equality and the approaches to social justice included in some judgments considered milestones in the area of social rights. The ideas of equality of opportunities, collective subject, granting of rights to communities, political justice, allow to approach John Rawls from his ideological positions, to then interpret judicial activism and its meaning in the light of the theory of justice, as new interpretation of the Constitution and jurisprudence.
