| dc.description.abstract | El presente estudio respondió a la pregunta ¿Por qué procede la tutela contra sentencias judiciales cuando se otorga la titularidad de un bien rural que no tiene antecedente registral, según la postura de la Corte Constitucional? Se hizo un estudio del precedente identificando una línea jurisprudencial que permitió concluir que las tierras que no tienen antecedente registral se presumen baldías, son de propiedad del Estado y están destinadas a ser adjudicadas por la Agencia Nacional de Tierras, por tanto, no pueden ser otorgadas por los jueces mediante el proceso de pertenencia. | spa |
| dc.description.abstractenglish | This study answered the question: Why does the protection against judicial sentences proceed when the ownership of a rural property is granted without a previous registration, according to the position of the Constitutional Court? A study of the precedent was made, identifying a line of jurisprudence that allowed the conclusion that the lands that do not have a registry record are presumed to be uncultivated, are owned by the State and are destined to be awarded by the National Land Agency, therefore, they cannot be granted by judges through the process of ownership. | spa |
