dc.description.abstractLa figura de la medida cautelar innominada, fue introducida en el proceso civil, por el Código General del Proceso. Las medidas Cautelares son una Institución procesal; siendo así que las innominadas, se han constituido en un recurso novedoso en el Código arriba mencionado. El régimen cautelar en el país tiene un amplio sustento en el marco de la Constitución Política. La medida cautelar innominada es llamada también atípica o genérica. Por definición son: instrumentales, provisionales y taxativas. Pese a que el Código Procesal del trabajo y de la Seguridad Social, no regula la medida cautelar innominada; es válido enfatizar que estas si pueden ser decretadas en procesos laborales y ellas deben ser estudiadas a la luz del Código General del Proceso.spa
dc.description.abstractenglishThe figure of the unnamed precautionary measure was introduced in the civil process, by the General Code of Process. Precautionary measures are a procedural institution; being so that the unnamed measures, have become a new resource in the above mentioned Code. The precautionary regime in the country has ample support in the framework of the Political Constitution. The unnamed precautionary measure is also called atypical or generic. By definition they are: instrumental, provisional and taxative. Although the Labor Procedure and Social Security Code, does not regulate the unnamed precautionary measure; It is valid to emphasize that these can be decreed in labor processes and they must be studied in the light of the General Process Code.spa
